Welcome to Movie Buddy. These Terms of Service ("Terms") are a legal agreement between you and Movie Buddy LLC, a Texas limited liability company ("Movie Buddy," "we," "us," or "our"), governing your use of the Movie Buddy mobile application, the website at moviebuddy.io, and any related services (together, the "Service").
Please read these Terms carefully. They include a mandatory arbitration provision and a class action waiver (Section 15) that affect how disputes are resolved.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
To use the Service, you must:
By using the Service, you represent that you meet all of these requirements. We may verify your eligibility at any time and may suspend or terminate your account if you do not meet it.
Registration. You must provide accurate, current, and complete information when you create your account, including your real first name, a valid email address, your actual date of birth, and your gender. Your date of birth cannot be changed after signup.
One account per person. You may create only one account. You may not create an account for anyone else or transfer your account to anyone else.
Security. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at support@moviebuddy.io if you suspect unauthorized access.
Verification. Before you can send or receive invites, you must complete three verification steps: confirm your date of birth, upload a profile photo, and confirm your location. You must also complete selfie verification to confirm that your profile photo is a photo of you. Accounts that fail or refuse verification cannot use the matching features.
Movie Buddy shows you movies playing in theaters near your location and lets you see other verified users nearby whose genre preferences match a given movie. You can send an invite with a message to another user to see a movie together. If they accept, a chat opens so you can make plans. If they decline, you are not notified.
Movie Buddy is a tool for arranging to see movies with other people. It is not a matchmaking service, does not guarantee that anyone will accept your invite, and does not guarantee the outcome of any meeting.
We do not run background checks. Movie Buddy verifies that users are 18 or older, that their profile photo matches a live selfie, and that they have provided a location. We do not conduct criminal background checks, identity verification beyond photo matching, or any other screening of users. You are solely responsible for deciding whether to interact with or meet another user.
We do not supervise meetings. When you and another user agree to meet, that meeting takes place outside the Service. We are not present, not responsible for what happens, and cannot intervene.
We do not guarantee accuracy. Other users provide their own profile information. We do not verify genre preferences, ideal movie night descriptions, or anything else users write about themselves.
Meeting someone from the internet in person carries risk. We strongly recommend that you:
If you are ever in danger, contact local emergency services (911 in the United States) first. You can also report the incident to us at safety@moviebuddy.io.
For more, see our Safety page at moviebuddy.io/safety.
You agree that you will not:
We may remove content, suspend accounts, or terminate accounts for violations of these standards, at our discretion, with or without notice.
What you own. You own the content you create on the Service, including your profile photo, your ideal movie night description, and your messages.
License to us. By posting content on the Service, you grant Movie Buddy a non-exclusive, royalty-free, worldwide license to use, store, display, reproduce, and distribute that content as needed to operate, improve, and promote the Service. This license ends when you delete the content or your account, except that (a) content you shared with other users may remain visible to them, and (b) we may retain copies as required for legal, safety, or fraud-prevention purposes.
Your representations. You represent that you have the right to post the content you post, that it is accurate, and that it does not violate these Terms or any law.
Our rights. We may review, screen, remove, or refuse any content at our discretion, but we have no obligation to do so.
You can block any user from their profile. Blocking is permanent, the blocked user is not notified, and blocked users cannot see your profile, appear in your carousel, send you invites, or message you.
You can report any user for violating these Terms. We review reports and may take action including warning, suspending, or terminating the reported user. We do not share the outcome of a report with the reporting user. Reports are confidential; the reported user is not told who reported them.
If you believe a user poses an immediate danger to anyone, contact local emergency services first, then email safety@moviebuddy.io.
Movie data. Movie information — including titles, posters, synopses, ratings, runtimes, release dates, cast, and genres — is provided by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. Movie data is provided as-is; we do not guarantee that showtimes, theaters, or availability are accurate.
Trailers. Movie trailers may be provided through YouTube or other third-party video services and are subject to those services' terms.
Identity verification. Selfie verification is performed by Veriff, a third-party identity verification provider, under its own privacy policy.
Other services. The Service may link to third-party websites or services. We are not responsible for their content, accuracy, or practices.
The Service, including its design, code, text, graphics, logos, and the Movie Buddy name and marks, is owned by Movie Buddy LLC and protected by copyright, trademark, and other laws. Except for the limited license to use the Service under these Terms, you receive no rights in the Service or its content.
You may not use the Movie Buddy name, logo, or marks without our written permission.
The Service is currently free to download and use. We may introduce optional paid features in the future. If we do, we will describe them and their pricing clearly before you are charged, and these Terms will be updated to cover them.
By you. You may delete your account at any time from Settings → Delete Account.
By us. We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, if your account is inactive for an extended period, or for any other reason at our discretion.
Effect. When your account is terminated, your right to use the Service ends immediately. Sections 7 (Your Content), 10 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Dispute Resolution), 16 (Indemnification), and 18 (General) survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY USER IS WHO THEY CLAIM TO BE; THAT ANY MEETING ARRANGED THROUGH THE SERVICE WILL BE SAFE; OR THAT YOU WILL RECEIVE ANY INVITES OR RESPONSES.
YOU USE THE SERVICE, AND MEET OTHER USERS, AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, MOVIE BUDDY LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS, WHETHER ONLINE OR IN PERSON, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR THE CONDUCT OF ANY USER, ONLINE OR OFFLINE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation of certain damages, so some of these limitations may not apply to you.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
15.1 Informal resolution. Before starting arbitration, you agree to contact us at legal@moviebuddy.io and attempt to resolve the dispute informally for at least 30 days.
15.2 Binding arbitration. If the dispute is not resolved informally, you and Movie Buddy agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including its formation, interpretation, or enforceability — will be resolved by binding individual arbitration, not in court, except as provided in Section 15.5.
15.3 Arbitration rules. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitration will take place in El Paso County, Texas, or by video conference, at your election. Movie Buddy will pay all AAA filing, administrative, and arbitrator fees for claims under $10,000, unless the arbitrator finds the claim frivolous.
15.4 Class action waiver. YOU AND MOVIE BUDDY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
15.5 Exceptions. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court to protect intellectual property rights.
15.6 Opt-out. You may opt out of this arbitration agreement by emailing legal@moviebuddy.io within 30 days of first accepting these Terms, with your name, the email address on your account, and a clear statement that you want to opt out of arbitration. If you opt out, this Section 15 will not apply to you, but the rest of these Terms will.
15.7 Severability. If the class action waiver in Section 15.4 is found unenforceable, then the entire Section 15 is void, and disputes will be resolved in court under Section 17.
You agree to defend, indemnify, and hold harmless Movie Buddy LLC and its members, managers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your content, (c) your violation of these Terms, (d) your violation of any law or the rights of any third party, or (e) your interactions with any other user, online or offline.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles, and by the Federal Arbitration Act. Subject to Section 15, any court proceeding will take place exclusively in the state or federal courts located in El Paso County, Texas, and you consent to personal jurisdiction there.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Movie Buddy regarding the Service.
Changes. We may modify these Terms at any time. If we make material changes, we will notify you through the app or by email before they take effect. Your continued use after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and delete your account.
Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign these Terms. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms do not create rights for anyone other than you and Movie Buddy.
Apple-specific. If you use the iOS app, you acknowledge that these Terms are between you and Movie Buddy, not Apple; that Apple has no obligation to provide maintenance or support; that Apple is not responsible for any product warranty, product claims, or intellectual property claims; and that Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
